  1. NightShade Computing License Agreement

  3. BEFORE USING THIS SOFTWARE, CAREFULLY READ THE TERMS AND CONDITIONS OF
  4. THIS AGREEMENT.  BY USING THIS SOFTWARE, YOU ARE CONSENTING TO BE BOUND
  5. BY AND ARE BECOMING A PARTY TO THIS AGREEMENT.  IF YOU DO NOT AGREE TO
  6. ALL OF THE TERMS OF THIS AGREEMENT, DO NOT USE THE SOFTWARE.

  8. 1. NightShade Computing ("NightShade") grants to you a non-exclusive,
  9. non-sublicensable, license to use this version of Sentry (the
  10. "Software"), in binary executable form.
  11.  
  12. 2. The software is provided 'as is' without express or implied
  13. warranties, including warranties of merchantability and fitness for a
  14. particular purpose or noninfringement.  NightShade shall not be liable
  15. under any theory or any damages suffered by you or any user of the
  16. software.

  18. 3. Title, ownership rights, and intellectual property rights in and to
  19. the Software shall remain in NightShade.  You agree to abide by the
  20. copyright law and all other applicable laws of Canada including, but not
  21. limited to, export control laws.  You acknowledge that the Software in
  22. source code form remains a confidential trade secret of NightShade and
  23. therefore you agree not to modify the Software or attempt to decipher,
  24. decompile, disassemble or reverse engineer the Software, except to the
  25. extent applicable laws specifically prohibit such restriction.

  27. 4. NightShade may terminate this License at any time by delivering
  28. notice to you and you may terminate this License at any time by
  29. destroying or erasing your copy of the Software.  Upon termination of
  30. this License, you agree to destroy or erase the Software.  This License
  31. is personal to you and you agree not to assign your rights herein.  This
  32. License shall be governed by and construed in accordance with the laws
  33. of Canada and, as to matters affecting copyrights, trademarks and
  34. patents, by Canadian federal law.  This License sets forth the entire
  35. agreement between you and NightShade.

  37. 5. NightShade shall not be liable for (a) incidental, consequential,
  38. special or indirect damages of any sort, whether arising in tort,
  39. contract or otherwise, even if NightShade has been informed if the
  40. possibility of such damages, or (b) for any claim by any other party.
  41. This limitation of liability shall not apply to liability for death or
  42. personal injury to the extent applicable law prohibits such limitation.
